COIDA legislation prescribes that all employers have to register as such with the Compensation Fund which falls under the Department of Labour. All employers registered with the Compensation Fund are obliged to submit Return Of Earnings (ROE) for the Compensation Fund to raise assessment notices which are payable within 30 days of the assessment notice date or in instalments at such times and conditions as the commissioner may determine. The assessments paid by the employers are used by the Compensation Fund to pay COID compensation or benefits to employees, service providers and employers consequent upon an accident arising out of and in the course of employment (IOD) or an occupational disease resulting in injury, sickness or death.
Compliance with COIDA legislation may be onerous to employers as it is not the employer’s core business and this may lead to non compliance with the relevant legislation. Non compliance with COIDA legislation constitutes a contravention of the Act and the Compensation Fund has the legislative authority to impose penalties for failure to comply with COIDA.
